API Terms of Use

1. Parties
This Agreement is made between Beautiful Places AI Community Interest Company (company number 15045216) whose registered office is at 71-75 Shelton Street, London, England, WC2H 9JQ ("we", "us", "our") and you, the user of the API ("you", "your").
2. Definitions
In this Agreement:
API means the Beautiful Places application programming interface and any associated documentation.
API Key means the unique authentication credential issued to you for accessing the API.
Data means any data, content, or materials provided through the API, including location data, scenic ratings, images, and any derived or aggregated information.
Derived Materials means any work, dataset, analysis, or other material created by you that incorporates, is based on, or is generated using the Data.
Referral Code means the unique code provided to you for use in attribution links.
3. Attribution Requirements
3.1 You must include a clearly visible link to Beautiful Places in any application or service that uses the API.
3.2 The link must:
(a) use the text "See more scenic places on the Beautiful Places app" or alternative text agreed with us in writing;
(b) link to https://www.beautifulplaces.ai/?ref=YOUR_REFERRAL_CODE, replacing YOUR_REFERRAL_CODE with the Referral Code provided to you;
(c) be clearly visible to end users of your application and not hidden, obscured, or placed in a location where users are unlikely to see it; and
(d) remain in place for as long as your application uses the API.
3.3 You may not use the API without displaying the required attribution link.
3.4 If you wish to use alternative attribution text, you must obtain our written approval in advance.
4. Image Credits
4.1 Some API responses include images from third-party sources that require attribution. Where attribution is required, the API response will include a credits field.
4.2 When displaying any image that includes a credits field, you must:
(a) display the attribution exactly as provided in the credits field (e.g. "© Martin Addison (cc-by-sa/2.0)");
(b) ensure the attribution is clearly visible and in reasonable proximity to the image; and
(c) not crop, obscure, or remove any attribution from the image itself.
4.3 Some images may be provided under Creative Commons licences. If you create derivative works from such images, you must comply with the terms of the applicable licence, which may require you to licence derivatives under the same terms.
4.4 You may not display images that include a credits field without showing the required attribution.
4.5 Images without a credits field do not require attribution.
5. Free Access Period
5.1 The API is currently provided free of charge during a testing period that will end on 31st December 2026. After this date, the API will become a paid service.
5.2 During the free access period, access is limited to a maximum of 4 users. All rate limits and quotas are shared across users.
5.3 We will endeavour to provide 60 days' notice of any significant changes to the service, including discontinuation of free access or transition to a paid service. However, we reserve the right to suspend or withdraw access immediately if required for security, legal, or operational reasons.
5.4 As this is a free service, we are not obligated to provide any particular level of availability or support.
6. Licence
6.1 We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the API and Data for the duration of this Agreement.
6.2 This licence is restricted to use of the API and Data by you only and only for integrating scenic location information into your applications.
7. Use Restrictions
7.1 You shall not:
(a) copy, reproduce, or store the Data in whole or in substantial part, except for reasonable caching as necessary for your application's normal operation (cached data must be refreshed at least every 24 hours);
(b) sell, lease, licence, distribute, publish, or otherwise make the Data available to any third party, or deal in or encumber it in any way;
(c) use the Data to create products or services that compete with us or that could reasonably be considered to form part of our business;
(d) use the Data in any unlawful manner or in a way that infringes third-party rights;
(e) scrape, bulk download, or systematically collect Data from the API to build or augment any database or dataset;
(f) attempt to reverse engineer, reconstruct, or extract the underlying data, algorithms, or data structures from the API;
(g) circumvent rate limits or usage restrictions by any means, including using multiple accounts or API Keys;
(h) share your API Key or fail to keep it secure;
(i) use automated means to access the API at a rate that exceeds what is reasonably necessary for your application's normal operation; or
(j) use the Data to train, tune, or validate any machine learning or artificial intelligence model.
7.2 You shall implement appropriate technical and security measures to protect the Data and prevent any unauthorised use or disclosure.
8. API Key Security
8.1 You are responsible for maintaining the confidentiality and security of your API Key.
8.2 You must notify us immediately at [email protected] if you believe your API Key has been compromised.
8.3 You are responsible for all activity that occurs under your API Key.
9. Intellectual Property
9.1 We own and retain all rights, title, and interest, including all intellectual property rights, in and to the API and Data (subject to third-party rights in images provided under Creative Commons licence).
9.2 Nothing in this Agreement transfers any ownership of intellectual property to you.
9.3 You shall promptly notify us if you become aware of any infringement of our intellectual property rights.
10. Service Availability and Changes
10.1 We reserve the right to modify, suspend, or discontinue the API at any time, with or without notice.
10.2 We reserve the right to change these Terms of Use at any time. Changes will be effective upon posting. Your continued use of the API constitutes acceptance of any changes.
10.3 We may revoke your access at any time, for any reason, without notice or liability.
10.4 We do not guarantee any level of availability, uptime, or performance.
11. Warranties
11.1 The API and Data are provided "as is" and "as available" without warranty of any kind, express or implied.
11.2 We do not warrant that:
(a) the API or Data will meet your requirements or achieve any particular outcome;
(b) the API will be uninterrupted, timely, secure, or error-free;
(c) the Data is complete, accurate, or reliable; or
(d) any errors or defects will be corrected.
12. Limitation of Liability
12.1 Nothing in this Agreement shall exclude or limit either party's liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded under applicable law.
12.2 Subject to clause 12.1, we shall not be liable to you for any:
(a) loss of profits, revenue, business, or opportunities;
(b) loss or corruption of data or information;
(c) loss of use or business interruption; or
(d) indirect, special, or consequential loss or damage,
in each case however arising, even if foreseeable.
12.3 Subject to clause 12.1, our total aggregate liability arising out of or in connection with this Agreement shall not exceed the total fees paid by you to us under this Agreement.
13. Indemnification
You shall indemnify and hold harmless Beautiful Places AI Community Interest Company and its officers, directors, and employees against all losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with your breach of this Agreement or your use of the API and Data.
14. Term and Termination
14.1 This Agreement is effective from your first use of the API and continues until terminated.
14.2 We may terminate this Agreement immediately by giving written notice to you if you commit a breach of this Agreement.
14.3 Upon termination:
(a) your licence and rights to use the API and Data will immediately cease;
(b) you shall immediately cease using the API and Data; and
(c) you shall delete or destroy all Data and any copies in your possession or control within 7 days of termination.
15. Privacy
Your use of the API is subject to our Privacy Policy which explains how we collect, use, and protect your information.
16. General
16.1 Neither party may assign or transfer this Agreement without the prior written consent of the other party.
16.2 If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16.3 Nothing in this Agreement creates a partnership, joint venture, or agency relationship between the parties.
16.4 This Agreement constitutes the entire agreement between the parties regarding its subject matter.
17. Governing Law and Jurisdiction
This Agreement is governed by English law. Any disputes arising under it shall be subject to the exclusive jurisdiction of the courts of England.
